Terms of Service

The short version

FOUR lets you say four words a day. You own what you write. Be decent to people. If you are cruel, we will remove you. We provide the service as-is and cannot promise it will never break or lose data.

The rest of this page is the long version. It is a binding agreement between you and Salish Studios ("we", "us"), the operator of FOUR.

Who can use it

You must be at least 13 years old to use FOUR. If you are under the age of digital consent where you live, you may not create an account.

You may not use FOUR if you have previously been removed for violating these terms, or if applicable law bars you from doing so.

One account per person. Accounts are not transferable and may not be sold.

Your words are yours

You keep all ownership of what you post. We claim no ownership of your four words.

You grant us a limited, worldwide, non-exclusive, royalty-free licence to store, display and transmit your content solely so we can operate FOUR — for example, showing your words in the feed, rendering a share card you asked for, or including them in your own archive. This licence ends when you delete the content or your account, except for copies already shared by others or retained in backups for a limited period.

We will not sell your words, licence them to third parties for advertising or model training, or use them in marketing without asking you first.

What you may not do

Post content that is unlawful, that threatens or incites violence, that sexualises minors, that harasses or targets a person or group on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity or sexual orientation, or that promotes self-harm.

Impersonate another person, or misrepresent your affiliation with any person or organisation.

Automate, scrape or bulk-access the service, create accounts by script, or attempt to circumvent the daily limits, rate limits, blocking, or any security control.

Use FOUR to send unsolicited commercial messages.

Moderation and enforcement

We may remove content, restrict features, or suspend or terminate an account that we reasonably believe violates these terms, with or without notice. Where practical and lawful we will tell you why.

You can report content in the app. Reports are reviewed by a person.

We may preserve and disclose content where we believe in good faith that the law requires it, or that doing so is necessary to prevent imminent harm.

Your account and your data

You may delete your account at any time. Deletion removes your profile, your days and your connections from the live service. Backups are purged on a rolling basis. See the Privacy Policy.

We may discontinue FOUR, in whole or in part, at any time. If we shut the service down, we will make reasonable efforts to give you notice and a way to export your archive.

No warranty

FOUR is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, secure, or error-free, that data will not be lost, or that content posted by other people will be accurate, lawful or inoffensive.

FOUR is not a crisis service. If you are in danger or considering harming yourself, contact your local emergency number or a crisis line.

Limitation of liability

To the maximum extent permitted by law, Salish Studios and its officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of FOUR.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to FOUR will not exceed the greater of (a) the total amount you paid us in the twelve months before the event giving rise to the claim, or (b) fifty US dollars (US$50).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited — including, in many places, liability for death or personal injury caused by negligence, or for fraud.

Content from other people

FOUR displays content created by other users. We do not endorse it and are not responsible for it. Where the law provides operators of interactive computer services with protection from liability for user content, we rely on it.

If you believe content on FOUR infringes your copyright, send a notice to hello@sayfour.com identifying the work, the content, and your contact details, with a statement made under penalty of perjury that you are authorised to act.

Indemnity

You agree to indemnify and hold Salish Studios harmless from claims, damages and reasonable legal fees arising from content you post or from your breach of these terms, except to the extent the claim arises from our own wrongdoing.

Changes

We may update these terms. If a change is material we will give notice in the app before it takes effect. Continuing to use FOUR after that means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws rules, and the courts there will have exclusive jurisdiction — except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings locally.
